• No Liability for Regulatory Fines: If any regulatory agency imposes labor-related fines or penalties on a user, GiveGigs.com is not responsible. (National Labor Relations Act, 29 U.S.C. § 151 et seq.)
• No Financial Guarantees: We do not guarantee payments, contracts, or services between users. (Uniform Commercial Code - UCC, Article 2)
• No Responsibility for Background Checks: Users are responsible for conducting their own due diligence. GiveGigs.com does not verify or conduct background checks on users.

3. User Responsibilities

Users acknowledge and agree that they are solely responsible for:

• Verifying the legitimacy of job offers and payments.
• Complying with local, state, and federal labor laws.
• Paying any applicable taxes on earned income. (Internal Revenue Code, 26 U.S.C.)
• Ensuring the safety and security of their personal information when interacting with others on the platform.
• Resolving any disputes that arise between users independently of GiveGigs.com.

4. Prohibited Activities

Users may not engage in activities that:

• Violate any laws or regulations.
• Involve fraud, misrepresentation, or deceptive practices. (Federal Trade Commission Act, 15 U.S.C. § 41 et seq.)
• Facilitate human trafficking or forced labor. (Trafficking Victims Protection Act, 22 U.S.C. § 7102)
• Involve discrimination based on race, gender, religion, nationality, disability, or other protected categories. (Civil Rights Act, 42 U.S.C. § 2000e et seq.)
• Use bots, scraping tools, or other automated means to collect data from the platform.
• Impersonate another person or falsely represent their qualifications, identity, or affiliations.

5. Third-Party Content & Links

GiveGigs.com may contain links to third-party sites. We do not endorse or assume liability for any third-party content or transactions. (Communications Decency Act, 47 U.S.C. § 230)

6. Indemnification

You agree to indemnify and hold harmless GiveGigs.com, its owners, affiliates, officers, and employees from any claims, damages, fines, or legal disputes arising from your use of the site. (Digital Millennium Copyright Act, 17 U.S.C. § 512)

7. Disclaimer of Warranties

GiveGigs.com is provided "as is" and "as available." We disclaim all warranties, including but not limited to:

• Any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Limitation of Liability

9. Governing Law

These Terms shall be governed by and construed under the laws of the State of New Hampshire, without regard to conflict of law principles. By using this service, you consent to the exclusive jurisdiction of the courts located in the State of New Hampshire for the resolution of any disputes.

10. Dispute Resolution & Arbitration

By using GiveGigs.com, you agree to resolve disputes through binding arbitration rather than litigation. (Federal Arbitration Act, 9 U.S.C. § 1 et seq.)

11. Privacy Policy & Data Security

Users acknowledge that their personal information may be collected and processed in accordance with GiveGigs.com’s Privacy Policy. (California Consumer Privacy Act, Cal. Civ. Code § 1798.100 et seq.) We implement industry-standard security measures but cannot guarantee absolute protection against breaches. (General Data Protection Regulation - GDPR, where applicable)

12. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the site after changes constitutes acceptance.

13. Termination of Access

We reserve the right to terminate or suspend user accounts at our discretion, without notice, for violations of these Terms or for any reason deemed necessary.

14. Data Retention

We retain your personal data only as long as necessary for the purposes outlined in our Privacy Policy, unless a longer retention period is required or permitted by law. You may request deletion of your data by contacting us, subject to legal and operational considerations.

17. Legal Eligibility and Sanctions Compliance

To access and use GiveGigs.com, you must be at least 18 years of age and at least the age of majority in your country of residence, and you must be legally authorized to enter into binding contractual agreements, including freelance or independent contractor arrangements, under applicable local laws.

By registering for and using our platform, you represent and warrant that:

• You are in full compliance with the employment and freelance laws of your jurisdiction;
• You are at least 18 years of age;
• You are not located in, or a resident of, any country or territory that is subject to comprehensive international sanctions, embargoes, or trade restrictions imposed by the United Nations, the European Union, the United States, or any other relevant authority;
• You are not listed on any government-issued sanctions or watchlists, including but not limited to the U.S. Office of Foreign Assets Control (OFAC) Specially Designated Nationals list.

GiveGigs.com reserves the right to restrict or deny access to users from countries or regions subject to such international sanctions. Users may also be restricted from selecting certain sanctioned countries during the registration process or may be blocked entirely from using the platform if required for legal compliance.

It is also the responsibility of the hiring party to ensure that the individuals or entities they engage through the platform are not subject to any international sanctions. This includes verifying that hired individuals are not personally named on any sanctions lists and are not located in or affiliated with a sanctioned country or entity.

We reserve the right to verify your eligibility at any time, request documentation, and suspend or terminate accounts found to be in violation of these legal and regulatory requirements.

18. Free Tools - No Liability for Data Loss or Security

GiveGigs.com offers free productivity tools including, but not limited to, a Time Tracker, Invoice Generator, and Task Management system (collectively, "Free Tools"). By using these Free Tools, you expressly acknowledge and agree that:

• No Data Security Guarantees: We make no guarantees regarding the security, integrity, or availability of data stored or processed through the Free Tools. Your data may be lost, corrupted, or compromised due to technical failures, security breaches, or other unforeseen circumstances.
• No Liability for Data Loss: GiveGigs.com shall not be held liable for any data loss, data corruption, unauthorized access, data leaks, or security breaches affecting data stored in or processed through the Free Tools. This includes, without limitation, loss of time tracking records, invoice data, task information, client details, or any other user-generated content.
• User Responsibility for Backups: You are solely responsible for maintaining independent backups of all data you enter into the Free Tools. We strongly recommend regularly exporting and saving your data to external storage systems.
• No Uptime Guarantees: The Free Tools are provided on an "as available" basis. We do not guarantee uninterrupted access or availability of these tools and may suspend, modify, or discontinue them at any time without notice.
• Beta/Experimental Status: Some or all of the Free Tools may be considered beta, experimental, or work-in-progress features. They may contain bugs, errors, or incomplete functionality.

By using the Free Tools, you acknowledge that you use them at your own risk and that GiveGigs.com bears no responsibility for any consequences arising from data loss, security incidents, or service interruptions.

20. Data Usage and Artificial Intelligence Training

By using GiveGigs.com and providing any data, content, or information to our platform (including but not limited to profile information, job postings, messages, time tracking data, invoices, tasks, and any other user-generated content), you expressly grant GiveGigs.com an irrevocable, perpetual, worldwide, royalty-free, and non-exclusive license to:

• Artificial Intelligence Training: Use all site data, including your personal information, content, and usage patterns, to train, develop, improve, and enhance artificial intelligence models, machine learning algorithms, and automated systems, whether developed by GiveGigs.com or third-party providers.
• Service Improvement: Analyze, process, aggregate, and utilize any and all site data to improve our services, develop new features, enhance user experience, conduct research, create analytics, and optimize platform performance.
• Third-Party Services: Share, transfer, or license site data to third-party service providers, partners, affiliates, or other entities for the purposes of improving their services, training their artificial intelligence systems, or conducting research and development.
• Data Anonymization and Aggregation: Create anonymized, de-identified, or aggregated datasets from site data for any commercial, research, or analytical purpose, including but not limited to sale or licensing to third parties.
• No Compensation: You acknowledge that you will receive no compensation, attribution, or royalties for the use of your data in AI training, service improvement, or any other purposes outlined in this section.

This license survives termination of your account and applies to all data submitted to GiveGigs.com, regardless of whether you subsequently delete your account or request data removal. While we may honor data deletion requests for privacy compliance purposes, we retain the right to continue using previously collected data in AI training and service improvement efforts.
